Version 5.0
Welcome to JustifiedReports. These Terms of Service govern your use of our AI-powered professional development platform. Please read them carefully before using the service.
JustifiedReports is operated by JustifiedForce, LLC. For support or billing questions, contact info@justifiedforce.com.
1. Acceptance; Electronic Contract
These Terms of Service ("Terms") are a binding agreement between you and JustifiedForce, LLC governing access to and use of JustifiedReports (the "Service"). By creating an account, affirmatively accepting the governing agreements, subscribing, or using the Service, you agree to these Terms, the Privacy Policy, and the applicable User Agreement and AI Disclaimer.
You consent to conduct transactions electronically and to receive agreements, disclosures, notices, billing records, and other Service communications electronically, subject to rights that cannot lawfully be waived. If you do not agree, do not use the Service.
2. Eligibility and Individual Law-Enforcement Use
The Service is intended for adults age 18 or older who are individual law-enforcement professionals or other persons expressly authorized by JustifiedForce. You represent that you have legal capacity to enter these Terms and that the information you provide is accurate.
An ordinary account is licensed to one individual only. It may not be transferred, shared, pooled, resold, or used as a department-wide, agency-wide, or multi-user account unless JustifiedForce expressly agrees in writing.
3. Nature and Purpose of the Service
JustifiedReports is an AI-assisted training, reflection, report-development, and professional-development platform. Features may include report review, guided debriefs, Learning Debriefs, an AI Coach, quizzes, scenarios, analytics, tutorials, Knowledge Vault tools, and Owner-managed reference materials.
The Service is not an official records-management, evidence-management, dispatch, CAD, case-management, chain-of-custody, supervisory approval, internal-affairs, prosecutor-review, court-filing, emergency, medical, mental-health, or legal service.
4. No Legal, Supervisory, Tactical, Medical, or Real-Time Operational Advice
The Service does not provide legal advice and does not create an attorney-client, work-product, supervisory, medical, psychotherapist, confidential-informant, fiduciary, or other privileged or professional relationship. Information submitted to or generated by the Service should not be assumed to be privileged, immune from discovery, exempt from public-records obligations, or protected from lawful process.
Do not use the Service to make real-time decisions during an emergency, pursuit, use-of-force event, search, seizure, arrest, detention, protective-custody event, tactical operation, medical or mental-health emergency, or other situation requiring immediate professional judgment. Applicable law, agency policy, training, supervisors, prosecutors, courts, and qualified counsel control over AI output.
5. Artificial Intelligence; Human Review Required
The Service uses artificial intelligence and automated systems. AI output is probabilistic and may hallucinate or confabulate facts, quotations, citations, cases, statutes, regulations, policies, or other authority; omit material information; misstate law or policy; rely on stale or incomplete material; reflect bias; misunderstand context; or produce inaccurate, incomplete, misleading, inappropriate, noncompliant, or non-unique content.
Every output is a draft, educational aid, or professional-development aid. You must independently review, verify, edit, and validate output before relying on it, acting on it, signing it, submitting it, filing it, distributing it, testifying from it, training from it, or using it for any official or professional purpose.
6. Legal Materials; Currency; No Continuous-Updating Obligation
The Service may contain or use statutes, regulations, judicial opinions, administrative decisions, policies, training materials, summaries, guidance, and other legal or professional reference materials uploaded, selected, indexed, summarized, or curated by JustifiedForce, users, third parties, or automated systems.
Legal materials may not reflect the most recent law. They may omit newer decisions, amendments, subsequent history, rehearing activity, appeals, reversals, vacaturs, superseding authority, negative treatment, distinguishing authority, corrections, unpublished decisions, or jurisdiction-specific developments. A source that was accurate when uploaded may later become outdated or noncontrolling.
JustifiedForce does not continuously monitor every court, legislature, agency, regulatory body, legal publisher, docket, or citator and has no duty to discover, upload, supplement, revise, Shepardize, KeyCite, validate, or remove legal material immediately or within any particular period after a legal development occurs. Owner-curated Global Knowledge may be updated periodically at JustifiedForce's discretion but is not represented to be comprehensive or current.
JustifiedReports is not a legal research service or citator. Before relying on legal authority for an official or professional purpose, you are responsible for independently verifying the current law, jurisdiction, precedential status, subsequent history, negative treatment, and applicability through appropriate official or authoritative sources.
7. User Responsibility for Official Conduct and Reports
You remain solely responsible for the truthfulness of facts you enter; the accuracy, completeness, attribution, and legal sufficiency of any report or document you prepare; and all professional decisions and official actions. The Service does not transfer responsibility for investigations, searches, seizures, arrests, use of force, detention, protective custody, warrants, affidavits, testimony, disclosures, evidence preservation, or compliance with law and policy to JustifiedForce.
You may not use AI to fabricate observations, quotations, evidence, probable cause, reasonable suspicion, witness statements, admissions, chronology, investigative steps, legal authority, or other facts.
8. Agency Authorization and Policy Compliance
Your individual subscription does not mean your agency, municipality, employer, prosecutor, court, POST body, training authority, union, insurer, or other organization has approved, endorsed, certified, or authorized the Service. You are responsible for determining whether and how your employer permits the Service to be used.
If law, court order, collective-bargaining obligation, agency policy, records rule, security rule, prosecutor instruction, or supervisory direction conflicts with the Service or these Terms, you must comply with the controlling requirement and refrain from using the Service for the restricted purpose.
9. Sensitive, Restricted, and Regulated Information
Do not enter, upload, transmit, dictate, or store information that you are not legally and organizationally authorized to provide to third-party cloud, software, transcription, payment, or AI services. Unless JustifiedForce expressly documents otherwise in writing for a particular deployment, the Service is not authorized for CJIS/CJI, NCIC or criminal-history restricted information, Social Security numbers, authentication secrets, payment-card numbers, protected health information, sealed records, highly sensitive juvenile information, confidential intelligence, protected witness or victim information, privileged communications, classified information, or other specially regulated or restricted data.
You are responsible for redaction, minimization, lawful authority, consent where required, and compliance with agency security rules and applicable law.
10. Discovery, Public Records, Brady/Giglio, Retention, and Legal Holds
Law-enforcement-related inputs, AI conversations, drafts, debriefs, generated outputs, stored documents, and account records may create legal, discovery, disclosure, retention, public-records, evidentiary, Brady/Giglio, labor, disciplinary, licensing, litigation, or legal-hold obligations depending on the facts and jurisdiction. JustifiedForce does not determine whether such obligations apply.
You are responsible for identifying and complying with preservation, disclosure, discovery, legal-hold, records-retention, public-records, evidence, employment, agency, and court requirements. Deleting material from the Service does not relieve any independent duty to preserve or disclose it.
11. Knowledge Vault; User Content; Upload Authority
Your personal Knowledge Vault is for material you are authorized to possess, transmit, and process. The storage allowance and technical limits shown in the Service apply to ordinary accounts. You retain your rights in content you upload.
You grant JustifiedForce and its service providers a limited, nonexclusive license to host, copy, transmit, process, transform, index, retrieve, display, secure, troubleshoot, and otherwise process User Content solely as reasonably necessary to operate, support, secure, improve, and provide the Service and comply with law.
You represent that you have all rights, permissions, consents, and legal authority necessary to submit User Content and permit that processing.
12. Data Retention, Backups, and No Archival Guarantee
The Service is not an archival, official records-retention, evidence-preservation, backup, or disaster-recovery service. Do not use it as the sole repository for material you are legally, professionally, operationally, or contractually required to preserve.
You are responsible for maintaining independent copies of important material. To the maximum extent permitted by law, JustifiedForce does not guarantee that User Content, drafts, conversations, Knowledge Vault materials, generated output, or account data will remain available indefinitely or can always be recovered after deletion, corruption, account closure, provider failure, security incident, technical error, or service change.
13. Privacy, Service Providers, and Security
The Privacy Policy explains how information is collected, used, disclosed, retained, and protected and is incorporated into these Terms. The Service relies on third-party infrastructure and processors for functions that may include authentication, application hosting, cloud storage, artificial intelligence, transcription, email, analytics, security, and payment processing.
No internet-connected system can guarantee absolute confidentiality, security, availability, or error-free operation.
14. Voice, Dictation, Audio, and Transcription
When you activate a microphone, voice-input, dictation, or transcription feature, you consent to the capture, transmission, automated processing, and transcription of audio or speech you intentionally provide as necessary to deliver that feature.
You may not use the Service to secretly record, intercept, capture, or transmit another person's communications where consent, a warrant, agency authorization, or other legal authority is required. You are responsible for applicable recording, interception, privacy, employment, and agency rules.
15. Owner and Administrative Access
Owner analytics and administrative tools may display identity and contact information, jurisdiction/profile information, subscription status, aggregate feature activity, storage totals, tutorial/help analytics, support tickets, agreement records, and security/system-health data. Platform-wide analytics are designed not to routinely expose the substantive body of private report narratives, coaching conversations, or personal Knowledge Vault documents.
Authorized JustifiedForce personnel and service providers may nevertheless access or process information when reasonably necessary to provide requested support, investigate security or abuse, operate or repair the Service, enforce the governing agreements, comply with lawful process, or protect rights and safety.
16. Account Security and Single-Device Rule
You must safeguard credentials and promptly report suspected unauthorized access. Ordinary accounts may be limited to one active device session at a time. Signing in on another device may terminate or block an earlier session.
You may not share credentials, bypass device or session controls, automate login sharing, transfer the account, or permit another person to use your subscription.
17. Acceptable Use
You may not use the Service unlawfully; introduce malware; probe, attack, or bypass security; interfere with availability; impersonate another person; scrape or systematically extract protected content; evade billing, usage, subscription, access, or device restrictions; use unauthorized automation; or use the Service to deceive, defraud, harass, discriminate, threaten, or intentionally harm another person.
You may not knowingly use the Service to create false official records, conceal misconduct, obstruct justice, destroy or suppress evidence, evade lawful discovery or records duties, or facilitate unlawful conduct.
18. JustifiedForce Intellectual Property and Product Protection
JustifiedReports, its source and object code, architecture, interfaces, designs, workflows, proprietary prompts and system instructions, methodologies, taxonomies, coaching structures, scoring systems, tutorial systems, documentation, branding, and other protected materials are owned by or licensed to JustifiedForce and are protected by intellectual-property and unfair-competition law.
Except where applicable law expressly permits otherwise, you may not copy, reproduce, publish, sell, sublicense, decompile, disassemble, reverse engineer, extract hidden prompts or instructions, systematically harvest protected workflows or outputs to replicate product functionality, remove proprietary notices, or create unauthorized derivative versions of protected Service components.
19. User Content and AI Output
As between you and JustifiedForce, you retain your rights in User Content. Subject to JustifiedForce's rights in the Service and applicable law, JustifiedForce does not claim ownership of factual report content you submit or your independently authored final work product.
AI-generated material may not be unique, may resemble material generated for others, and may not qualify for intellectual-property protection. You are responsible for verifying output and determining whether you may lawfully use it.
20. Subscription Pricing, Taxes, and All-Inclusive Access
Current web subscription pricing is $19.99 plus applicable tax month-to-month or $179.88 plus applicable tax paid up front for one year, equivalent to $14.99 per month before applicable tax. Both options provide the standard JustifiedReports Law Enforcement platform on an all-inclusive basis with no report-count billing limit and no per-report or report-overage charge under the current pricing model. Current checkout disclosures control the amount charged for a transaction.
Displayed subscription prices are exclusive of applicable sales, use, excise, value-added, or similar taxes unless expressly stated otherwise. Applicable taxes may be calculated, added, collected, or remitted by JustifiedForce, its payment processor, an app marketplace, or another authorized billing provider as required by law.
Features, providers, and plan pricing may change prospectively with notice as required by applicable law.
21. Automatic Renewal, Cancellation, and Refunds
Subscriptions automatically renew for the selected billing interval until canceled. Before checkout, the Service displays the billing interval, price, renewal nature of the subscription, and transaction-specific disclosures. Renewal pricing may change prospectively with notice as required by applicable law.
You may cancel online through available Billing or Manage Billing controls. To avoid a renewal charge, cancel before the renewal is processed. Cancellation generally takes effect at the end of the already-paid term unless law or the applicable payment platform requires otherwise.
Subscription fees are generally nonrefundable after charge except where required by law or for a verified duplicate, unauthorized, or erroneous charge attributable to JustifiedReports or its payment processor.
22. Payment Processors and App Stores
Web payments may be processed by Stripe or another authorized processor. If the Service is distributed through Apple, Google, or another app marketplace and you purchase through that platform, the platform's payment, tax, renewal, refund, and cancellation rules may also apply. JustifiedForce does not store full payment-card numbers processed by a third-party payment provider.
23. Service Changes, Third-Party Dependencies, and Force Majeure
Features, models, providers, storage methods, interfaces, limits, pricing, and availability may change. JustifiedForce may add, modify, suspend, or discontinue features or the Service subject to applicable law and contractual obligations concerning prepaid access.
To the maximum extent permitted by law, JustifiedForce is not responsible for delay, interruption, degradation, or inability to perform caused by circumstances reasonably outside its control, including telecommunications or Internet failures, cloud or AI-provider outages, payment-processor or app-marketplace failures, government action, labor disruption, natural disaster, widespread utility failure, war, terrorism, civil disorder, or cyberattack despite reasonable safeguards.
24. Suspension and Termination
JustifiedForce may suspend, restrict, or terminate access when reasonably necessary for nonpayment, suspected credential sharing, security or abuse concerns, unlawful conduct, material breach, legal compliance, protection of users or third parties, or protection of the Service and its intellectual property. Where practicable, JustifiedForce may provide notice and an opportunity to cure, but immediate action may be taken when reasonably necessary.
25. Warranty Disclaimer and Assumption of Risk
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, AI OUTPUT, GLOBAL KNOWLEDGE, LEGAL MATERIALS, TUTORIALS, AND RELATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ACCURACY, COMPLETENESS, CURRENCY, LEGAL SUFFICIENCY, POLICY COMPLIANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
You knowingly assume the risks inherent in generative AI, cloud storage, electronic transmission, voice transcription, third-party processing, provider dependency, and legal-reference collections that may not be current.
26. Released Parties; Release of Ordinary-Negligence Claims
For Sections 26 through 29, "Released Parties" means JustifiedForce, LLC and its current and former members, managers, officers, employees, representatives, agents, contractors, consultants, licensors, affiliates, successors, assigns, insurers, technology providers, hosting providers, cloud providers, artificial-intelligence providers, transcription providers, payment processors, and other service providers, and the respective personnel of those persons or entities acting within the scope of their relationship with JustifiedForce.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE THE RELEASED PARTIES FROM CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE SERVICE, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF A RELEASED PARTY IN DESIGNING, OPERATING, HOSTING, MAINTAINING, SUPPORTING, SECURING, PROCESSING, OR PROVIDING THE SERVICE.
The release does not apply to the extent a claim results from a Released Party's gross negligence, reckless or willful misconduct, intentional wrongdoing, fraud, or other liability or right that applicable law does not permit to be released or waived.
27. Covenant Not to Sue; Limitation of Liability
To the maximum extent permitted by law, you agree not to commence, maintain, finance, direct, or voluntarily assist a proceeding against a Released Party based on a claim expressly released under the governing agreements. This does not restrict government reporting, cooperation with lawful process, nonwaivable statutory rights, or claims excluded from the release.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES; LOST PROFITS OR REVENUE; LOSS OF DATA OR GOODWILL; LOSS OF BUSINESS OPPORTUNITY; OR EMPLOYMENT, DISCIPLINARY, LICENSING, CERTIFICATION, CRIMINAL, CIVIL, ADMINISTRATIVE, EVIDENTIARY, TRAINING, OR PROFESSIONAL CONSEQUENCES ARISING OUT OF OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF JUSTIFIEDFORCE AND THE OTHER RELEASED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR GOVERNING AGREEMENTS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU ACTUALLY PAID TO JUSTIFIEDFORCE FOR THE SERVICE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
28. Indemnification and Defense
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Released Parties from third-party claims, damages, judgments, penalties, liabilities, costs, and reasonable attorneys' fees arising from your unlawful or unauthorized use of the Service; User Content you lacked authority to submit; violation of another person's rights; material breach of the governing agreements; fabrication, alteration, misrepresentation, or misuse of AI-generated content or legal authority; or prohibited real-time operational use.
JustifiedForce will provide reasonable notice of an indemnified claim when practicable. You will provide reasonable cooperation. JustifiedForce may control the defense and settlement of a claim involving a Released Party, subject to the limitations stated in the User Agreement. Indemnification does not apply to the extent a claim is finally determined to result from the indemnified party's gross negligence, reckless or intentional misconduct, fraud, or conduct for which indemnification is prohibited by law.
29. Binding Effect; Estate; Heirs; Representatives; Third-Party Beneficiaries
The assumption-of-risk, release, covenant-not-to-sue, limitation-of-liability, and indemnification provisions are binding upon you and, to the maximum extent permitted by applicable law, your estate, heirs, beneficiaries, personal representatives, executors, administrators, successors, assigns, and persons asserting claims through, on behalf of, or derivatively from you. Nothing purports to waive an independent legal right of a nonsignatory when applicable law does not permit you to waive that right.
The Released Parties are intended third-party beneficiaries of the provisions that expressly protect them and may enforce those provisions directly to the extent permitted by law.
30. Governing Law and Disputes
Before filing a nonemergency claim, the parties agree to make a good-faith effort to resolve the dispute informally after written notice describing the issue and requested relief. This process does not require a party to allow a limitations period to expire, bar urgent injunctive relief, or restrict a right that cannot lawfully be waived.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, subject to applicable federal law and nonwaivable rights. To the extent permitted by law, judicial proceedings arising from the Service or governing agreements shall be brought in a state or federal court having jurisdiction in Worcester County, Massachusetts, except where applicable law requires another forum or permits use of a small-claims forum.
31. General Terms; Severability; Assignment; Changes; Contact
If a provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and, where legally permissible, narrowed rather than voided in its entirety. The remaining provisions remain effective. Failure to enforce a provision is not a waiver.
You may not assign your account or these Terms without JustifiedForce's written consent. JustifiedForce may assign the governing agreements in connection with a merger, financing, reorganization, sale of assets, change of control, or transfer of the Service, subject to applicable law.
These Terms, the Privacy Policy, the User Agreement, and transaction-specific billing disclosures constitute the applicable agreement concerning the Service, subject to any separate written agreement signed by an authorized representative of JustifiedForce. JustifiedForce may update these Terms as the Service, law, technology, providers, or risk profile changes. Material changes may require renewed affirmative acceptance before further use.
